PRIVACY POLICY

Welcome to the Darom Adom application.

This Privacy Policy (the “Privacy Policy” or “Policy”) describes the personal data that The Organization To Promote Tourism In Shikma-Besor (“Organization”, “we”, “us”, “our”), collects, uses, processes, shares and stores when you use our application during the walk (hereinafter the "App" or the "Application").
We hereby inform you, and you hereby acknowledge that you have no legal obligation to provide us with any personal data when you use the application, and the provision of it is solely based on your free will.

1. WHAT PERSONAL DATA DO WE PROCESS ABOUT YOU?

1.1. Personal data that you provide us with
The personal data we process and collect directly from you through the application is the Location and traffic data (e.g. country) only;
If you refuse to provide this personal data, you may be prevented from using the application.
To count your steps, you must allow the application access to the pedometer on your device. Access to the pedometer will only be possible when using the application. You must close the application and/or delete it when you finish using it. In any case, the counting of steps will stop automatically at the end of the day of the walk.

1.2. Personal data that we collect automatically from you
We use cookies to collect and analyze data regarding your use of the Application. The cookies we use do not directly identify you.
We may utilize the services of third parties, such as Google Analytics, to collect and analyze statistical and anonymous information. This information helps us understand your use of the Application, and track the performance of the Application. We do not control such third parties’ privacy practices and we encourage you to read them carefully before using the Site.

2. FOR WHAT PURPOSES DO WE USE YOUR PERSONAL DATA?

• Show you your step count and allow you to participate in the walk together with worldwide participants.

• For research purposes and for further analysis and statistics, where data will be anonymized where possible, to improve our Application (for example, we analyze information collected through Google Analytics to help us understand behavior when accessing the Application).

• In order to enforce this Privacy Policy, resolve disputes, exercise or defend our legal rights, comply with any applicable law, regulations or requests from competent authorities, or as otherwise authorized by you.

3. LEGAL BASIS FOR PROCESSING

We only process personal data where we have a lawful basis to do so. The lawful basis will depend on the reasons we collected the personal data and purposes we use your personal data, and may differ according to applicable data protection laws.

The lawful basis for processing will be: (a) If you are based in Israel, when you gave us your consent for processing data for one or more of the purposes listed above; or, (b) when processing is required in order to take actions based on your request; (c) If you are based in the EU/EEA, where we have a legitimate interest to process the your data. For example, to identify and prevent abuse of the Application or to ensure the security of the Application; and (d) To comply with any legal obligation that may apply to us. For example, to disclose information to competent authorities.

4. WITH WHOM DO WE SHARE YOUR PERSONAL DATA?

We may share your personal data with the following recipients:

Service Providers. We may share personal data with our contracted service providers and subcontractors so they can provide us with services required for us to operate the Application, such as – cloud and IT vendors, hosting (Azure, eastern US region), advertisers, companies that provide analysis and processing activities, companies that provide us marketing and promotional services.
Analytics. We share your internet and other electronic network activity information with third-party providers that assist us in the improvement and optimization of the Application and process personal data in the context of the provision of analytical services to us.
Protection of Rights. If we need to do so to establish, exercise, protect or defend our contracts or legal rights, or the rights of others including our employees and affiliates, or detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, we may share personal data with investigators, advisors, consultants or law enforcement authorities.
Official Authorities. We may need to disclose personal data in response to lawful requests by public authorities or law enforcement officials, including meeting national security or law enforcement requirements. We cooperate with government and law enforcement officials to enforce and comply with the law.

5. HOW IS YOUR PERSONAL DATA TRANSFERRED ACROSS BORDERS?

5.1. How is your personal data transferred outside of Israel?
When we transfer personal data from the State of Israel to a third country outside Israel, the transfer takes place on the basis of:

• To a country declared as offering equivalent level of protection by the Israeli Privacy Protection Authority;

• another approved transfer mechanism under the Israeli regulations; or

• you consent to transfer your personal data to other jurisdictions, understanding that in some countries the level of protection may be lower than in Israel.

5.2. How is your personal data transferred outside of the European Union/ European Economic Area?
When we transfer personal data from within the EU/EEA to countries or international organizations that are based outside the EU/EEA, the transfer takes place on the basis of:

• an adequacy decision by the European Commission; or

• in the absence of an adequacy decision, other legally permitted safeguards such as standard contractual clauses (“SCCs”) for the transfer of personal data to third countries.

6. HOW LONG DO WE STORE YOUR PERSONAL DATA FOR?
We store personal data for various reasons and periods of time, as required by Applicable Laws or for the performance by contracts we are bound to and/or to fulfill our legitimate interests; and/or as permitted by Applicable Laws. The length of time we store your personal data depends on the purposes for which we collect and use it and/or as required to comply with Applicable Laws and to establish, exercise or defend our legal rights.

7. HOW DO WE KEEP YOUR PERSONAL DATA SECURE?
We will retain Personal data for as long as required and needed to comply with our legal obligations or to pursue our legitimate purposes and to establish, exercise or defend our legal rights, unless otherwise restricted under applicable law.

8. WHAT RIGHTS DO YOU HAVE REGARDING YOUR PERSONAL DATA?

8.1. General provisions
Please note that you may have certain rights regarding the manner of collection, processing, and usage of your personal data pursuant to Applicable Laws.
At any time, you may contact us at: zfonhanegev@gmail.com and request to know what personal data we store about you. We will consider all such requests and provide our response within a reasonable period.

8.2. Information for Israeli Data Subjects
If you are based in Israel, you are entitled to request us to:

review your personal data that we process;

update, amendment, and deletion of personal data which is incomplete or outdated.

8.3. Information for EU/EEA Data Subjects
If you are based in the EU/EEA, you are entitled to request us to:

access your personal data in order to obtain clear, transparent and understandable information on how we process your personal data and on your rights (as provided in this Policy), as well as a copy of your personal data;

rectify your personal data in case your personal data are obsolete, inaccurate or incomplete;

object the processing of your personal data when the processing is based on the Organization’s legitimate interest.
• in certain circumstances under Applicable Laws, restrict the processing of some of your personal data during a limited period of time;

withdraw your consent when it has been obtained and processing is based on consent;

• in certain circumstances under Applicable Laws, request data portability, meaning that you can receive the personal data originally provided by you in a structured and commonly used format or that the data subject can request the transfer of the personal data provided by him or her to another data controller;

• in certain circumstances under Applicable Laws, delete your personal data (also known as the right to be forgotten);

lodge a complaint with your national data protection authority.

9. DOES THIS PRIVACY POLICY APPLY TO THIRD PARTY LINKS?

You may, during your use of the Application, access links to or other websites operated by third parties outside of the Organization. Please note that this Privacy Policy only applies to personal data that we (or third parties on our behalf) collect from or about you and we cannot be responsible for personal data collected and stored by third parties. Third party websites have their own terms and conditions and privacy policies, and you should read these carefully before you submit any personal data to these websites. We do not endorse or otherwise accept any responsibility or liability for the content of such third-party websites or third-party terms and conditions or policies.

10. HOW DO WE APPROACH CHANGES TO THIS PRIVACY POLICY?
We will change this Privacy Policy from time to time. Any changes we make to our privacy policy in the future will be posted on this page.
